What is a brand contract for AI agents?

A brand contract is a single, machine-readable set of rules that defines what may — and may not — go out under your brand, for humans and AI agents alike. It covers tone of voice, the product catalog, the claims you are allowed to make and the channels you publish in, written so a machine can check a draft against them before anyone sees it. In our own corpus of documented AI brand incidents, ten of eighteen would have been stopped by one such check against a rule the brand already had (Tisser, blunder dossier, August 2026).

This is about your brand, not about IT governance. A brand contract does not manage model access, data residency or vendor risk — those are separate questions with separate owners. It governs one thing: what is allowed to leave the building with your name on it.

Why the term exists

Brand guidelines were written for people. They describe: “we sound optimistic but grounded”. A person interprets that; an AI agent interprets it differently every single time. A contract decides instead of describes — “claims comparing us to competitors require a source on file” — and a decision can be checked, enforced and logged.

The word contract is doing real work here. A guideline has no consequence when it is ignored. A contract does: a draft that breaks rule 4.2 is refused, with the rule and the page named, before publication.

What a brand contract contains

  • Voice and tone — how you sound, in rules rather than adjectives.
  • Product and catalog — what you sell, at which tier, with which prices and features.
  • Claims and proof — what you may assert, and the approved material each assertion rests on.
  • Channel rules — specs, length and register per channel.
  • Refusals — what may never be said, in any channel, by anyone.
  • Approvers — who may sign off on what.

How it differs from things it is confused with

Not brand guidelines
Guidelines describe and persuade; a contract decides and can be enforced. Most brand contracts start life as a guideline document.
Not a style guide or prompt library
A prompt library gives instructions. Instructions are not enforcement: nothing stops an output that ignores them, and nothing logs what went out.
Not AI governance
AI governance covers model choice, data handling and risk across the organisation. A brand contract governs published output under one brand.
Not a legal contract
Nobody signs it with a counterparty. It is an internal rule set, versioned and owned by your brand team.

Who owns it

Your brand or marketing lead, with legal in a reviewing role. The test of a working brand contract is that your own team can change a rule without calling a vendor — including us.
